Terms of Services

Welcome to Phisk AI, a service of Phisk Corporation. These Terms of Service ("Terms") govern your access to and use of our AI tools, APIs, and services, including those that integrate with third-party platforms. By accessing or using Phisk AI, you agree to these Terms. If you do not agree, please do not use the Service.

1. Definitions

  • Phisk AI: The artificial intelligence platform, tools, APIs, and services provided by Phisk Corporation.
  • User / You: Any individual or entity using the Service.
  • Content: Any data, prompt, media, or material you input or that is generated using the Service.
  • Third-Party Services: External services, models, or APIs integrated into Phisk AI, including but not limited to OpenAI, Fal.ai, Grok, Veo, and others.

2. Eligibility

You must be at least 13 years old to use Phisk AI. If you are using the Service on behalf of an organization, you confirm that you are authorized to bind the organization to these Terms.

3. Use of Service

You agree to:

  • Use the Service in a lawful manner.
  • Not misuse the platform to distribute harmful, false, infringing, or offensive content.
  • Not attempt to reverse-engineer or tamper with the underlying code, models, or infrastructure.

4. Account & Access

Some features require an account. You are responsible for:

  • Securing your login credentials.
  • Any activity under your account, authorized or unauthorized.

Phisk Corporation may suspend your account if it detects abuse or violation of these Terms.

5. Intellectual Property

  • All rights to the models, services, and designs used in Phisk AI belong to Phisk Corporation or its licensors.
  • You retain ownership of your input content, but by using the Service, you grant us permission to process and analyze that content to deliver results.

6. Generated Content

  • Output from Phisk AI is machine-generated and may be inaccurate, incomplete, or inappropriate.
  • You are solely responsible for reviewing and validating all AI-generated output before use or publication.

Phisk Corporation is not liable for any consequences resulting from your use of generated content.

7. Third-Party Integrations

Phisk AI integrates with third-party AI technologies and platforms to enhance functionality. These include but are not limited to:

  • OpenAI – For advanced natural language processing and generation.
  • Fal.ai – For real-time AI inference and computer vision.
  • Grok – For context-aware, AI-powered reasoning and search.
  • Veo – For AI-generated video capabilities and creative content.
  • Other Providers – Additional AI and data services as we expand functionality.

By using these integrated features, you agree to:

  • Be bound by the Terms of Service and Privacy Policies of these third-party providers.
  • Understand that third-party services may store, process, or transmit your data according to their own compliance and privacy frameworks.
  • Accept that Phisk Corporation is not responsible for the performance, security, or data handling practices of third-party services.

Note: The availability, accuracy, and pricing of certain features may vary depending on the terms of each third-party service.

8. Pricing & Payment

Phisk AI uses a Pay-as-You-Go model. You agree to:

  • Pay all applicable usage fees.
  • Maintain valid and current billing details.

All charges are non-refundable unless explicitly stated otherwise.

9. Privacy

Please review our Privacy Policy to understand how we collect, use, and protect your data.

If you use third-party integrations, your data may also be governed by their privacy terms.

10. Service Availability

We aim for high availability but do not guarantee continuous access. The Service may be temporarily unavailable for maintenance, upgrades, or due to technical issues.

11. Termination

We may suspend or terminate your access to the Service without notice if:

  • You violate these Terms.
  • We are required by law or regulatory authorities.
  • Your use endangers the platform or other users.

You may terminate your use of the Service at any time by discontinuing use and closing your account.

12. Limitation of Liability

To the maximum extent permitted by law, Phisk Corporation shall not be liable for:

  • Any indirect, incidental, or consequential damages.
  • Any loss of profit, revenue, or data.

13. Indemnity

You agree to indemnify and hold harmless Phisk Corporation and its affiliates against any claims, damages, or liabilities arising from your use of the Service or violation of these Terms.

14. Modifications

We may revise these Terms at any time. Continued use of Phisk AI after changes are made constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law provisions.
